according to the attorney my wife cant take any legal action against the company she works for. because she did loose a limb or suffer any perminant pysical injury the so all she can do is claim workers comp and watch the bills get bigger and bigger. stupid fucking law as far as i can see it. they where to blame but she dosnt have a leg to stand on when it comes to claiming. and to take out a personal lawsuit against them it would cost to much upfront.

if it is the companys fault she got hurt call osha i know osha is not what they use to be but they will make sure if it unsafe they will make them fix the problem

hey bob, sorry to read about what you are going through. I was working in iowa and fell 25 feet due to a faulty latch on a scissor lift door. I was told that a judge in iowa will never assign 50 percent responsibility to an employer unless there is an expensive(for the injured party) and lengthy lawsuit! How bogus!! Four surgeries and 5 years later, I am no longer  an Ironworker and the settlement was less than what I could have made in 2.5 years at just my locals hourly wage. that is minus all of the retirement benefits and such that i would have earned working! I hope things work out for you. I have been there. I feel for you. ROOKIE

i agree u need to report it to iosha they will investigate..but i dont see how they can tell u cant take actions against them when the company was at fault...that dont make since..

That is just so fucked up. I can not believe some of the laws we have on the books in this Country to screw the working class.

OSHA will only fine the company, it won't get you any money, workers comp should pay 100% of the bills

Sorry to hear this English Bob.  I agree with Gator Girl that Work man's Comp should pay 100% of all bills related to the accident.
