But even in this case where guilt is beyond any doubt, we must follow the law - which is the real problem. Either he will be found guilty of first degree murder, or, he will be found innocent by reason of insanity. As to the former, he may be sentenced to life in prison without parole, or, execution, where he will sit it out in a - by world standards - very comfortable prison environment for 20 some years through countless appeals before justice finally is done. And even when that moment comes, justice will be painless and swift, so as not to be "cruel and unusual." If the latter, he will receive "treatment" at some even more plush giggling factory likely for the rest of his life - but always with the potential to be "cured" and released. It shouldn't be that way, and it wasn't meant to be. Again, and only where guilt is beyond doubt (dozens of witnesses, etc.): - The right to appeal should be protected but fast-tracked and ruled on by a new level of the judiciary if necessary to get through this process in a more reasonable time - a year or two at most. - If execution is decreed, it should be by traditional means: snap his neck or fry his ass. Why should the ultimate punishment be painless? - The insanity defense should done away with. If someone is insane and kills, his life still should be forfeit. The intent, after all, is to protect society. Add to that for every shrink who says someone is nuts, you can find another shrink to dispute it. Until it's an exact science, it should not be used to evade guilt. Awards
