Blizzard Sued “Cheat” Maker and Won Millions in Copyright Damages

The German company, which developed several popular game cheats and hacks, lost a copyright infringement case to Blizzard Entertainment, with the court ordering it to pay more than $8.5 million in copyright damages. Besides, the cheat maker won’t be able to market or sell its products in the US. It is a significant loss for the German cheat maker, but it didn’t really come as a surprise given that it failed to defend itself.

Along with the gaming market, the market for “cheats,” “hacks” and bots has also rapidly increased, and Bossland was one of the frontrunners in this field, creating cheats and bots for a range of popular Blizzard games such as World of Warcraft, Diablo 3, Heroes of the Storm, Hearthstone, and Overwatch. In short words, its products gave users an unfair advantage over the competition. Blizzard has been pursuing Bossland for quite some time, both in the US and Germany.

Now a prominent US case came to a conclusion, which was relatively easy for Blizzard, since Bossland didn’t even show up and thus was ordered to pay several million in copyright damages. Blizzard claimed (and the court agreed) that hacks developed by the German company were able to bypass Blizzard’s cheat protection technology “Warden” and violated the DMCA. The game developer argued that Bossland infringed its copyrights and allowed its users to do the same through reverse engineering of the games and allowing users to play modified versions.

Blizzard explained to the court that infringing actions were damaging to it because they rendered its anti-cheat protection ineffective and eventually ruined the gaming experience for other players who may lose interest in playing, thus causing additional damage.

The court decided to side with the game developer and granted the statutory copyright damages requested for nearly 43,000 violations within the US, totaling more than $8,5 mln. On top of that, the game developer is entitled to about $175,00 in attorneys’ fees. Finally, the German company was also prohibited from marketing or selling its cheats in the US, in order to prevent further damage. However, cheats will remain widely available outside of the US for now.
