Most newer cards will thermal throttle both the GPU and VRMs long before the driver crashes due to heat. I'de say it's defective. RMA the damn thing if you can. I guess not ll of the PCB or VRM's are having sensors to be able to cut that out. Plus, at least it does shutdown to prevent (more) damage. I hope he got that RMA support. Nvidia said that i have to have receipt/invoice to file a RMA ticket. Cause they dont know where i bought the card. And i called the place that i originally bought the card from and they said that they cant Reprint a receipt due to thief reasons.(Have no fucking clue how that has to do with thief). What could also be enough, is your proof of buy, that you send them the bank information receipt. They can check that for you. If not, you still have some rights by law. And they can make NVidia clear, that should be enough. They can check with the serialnumber. (here in the Netherlands, they are more unlucky. We don't have that 2 year rule. OEM's videocards are not listed with NVidia. Most of the times those videocards are bought in BULK. The only warranty right you have is, with that system, period.
