The contracts state the modern era and WW2 to Vietnam, more or less. The plaintiffs were the former heads of IW that were fired by Activision. Dunno if they settled out of court but considering the animosity between them I am not so sure. Also I think Activision's rationale was that there was a difference between future and near-future. So while the servers are there the only way to get into them is matchmaking. A dumb idea if you ask me but I suppose the majority of players these days want matchmaking.
