This past weekend I was at my Pocono house with my oldest son and grand kids.

 

My youngest son has a older Mustang, uninsured, parked in my home driveway. On my return home we notice there is damage to the roof of the car. We also notice my next door neighbor has had tree work done between our two houses. It is apparent one of the limbs cut landed on my sons car.

 

I approach the neighbor and he claims ignorance of any incident and said he only had his lawn service cleaning up broken branches and no knowledge of anything hitting my son's car even after showing him where the branches were chain sawed. He claims ignorance.

 

I see my neighbor across the street who is usually always at home and he is hesitant to say anything but eventually tells me the lawn crew was cutting branches from my next door neighbors trees with a long pole type of chain saw. After he tells me this he sort of hesitates and tells me he does not want to get involved leaving me to think he knows more than he told me.

 

Well it is my son's issue to try and settle but I do not offer him much hope especially since the car is not insured.

 

But it certainly damages my faith in neighbors.

 

Just exasperating to find out how people can be. Were I to have acted as either one of my neighbors did my parents would have rose form the grave to kick my ass.

Call the cops and file a report. Your neighbor is only financially responsible if the tree trimming company won't pay for the damages, and if that's the case your neighbors home owners insurance will have to pay for it. If they don't own up to it, file a small claim and let the judge decide. It sounds like you aren't friends with the neighbors anyway, and if they're going to treat you like this, no reason not to let the system work for you. And if your other neighbor refuses to tell the police the truth about what he saw, tell him that your lawyer will have him record a deposition under oath, and if he doesn't tell the truth he'll be a lot more involved than he ever wanted to be. Perjury is a felony.

The tree cutting service should be bonded with insurance. You should check on that. If not then yes file a report with the local pd and go to small claims court.

in this situation ....with property damaged being cause here by a company that didnt say anything bout it and knows it happens and not report if im not mistaken that becomes criminal damages...its just the same as a hit and run on the road...definately have ur son call pd to report this they will get to the bottom of it...

At this point I am going to leave my son address the issue since it was his car. He's a grown man and IMHO, his responsibility.

 

Besides he has had that damn car sitting in my driveway for more than a few years now. I don't know the year or model but is one of the more desirable Mustangs.

 

I have counseled him to file a police report if he gathers no more information than I.

 

I did search Google and the prospects are not good if a person at fault cannot be identified. There was a storm in the area Friday night and the possibility of fallen limbs exists so the cleanup could be somewhat valid. Still, if something had hit the car it would have been nice to have been told.

 

As for responsibility for a fallen neighbors tree it's probably my insurance companies responsibility.

either the your neighbors home owners insurance should cover it or the insurance from the company hired to cut the trees down. You need a police report. Call the police. Take lots of pictures of the car the trees they cut around it etc.

Seems if the storm caused a branch to fall then it would've still been on the car and obvious what happened.   Normally I would do whatever possible to settle this between neighbors but obviously they don't want to own up and what kind of tree trimming business would remove the branch and not say anything .. that right there tells me they are losers and should pay for the damages.  Maybe they don't have insurance ?  I'd do like everyone said (except ghostfacejim lol) and file the report unless your son doesn't think the damages are worth the trouble but I'd want to get it fixed.   And he should get parked car insurance, it's cheap and worth it.

I have one crappy neighbor. Amazing what people are willing to do. The rest of my neighbors get along great and we even help one another as needed. Amazing that can still happen these days. 

 

Sucks Shamu.. but your son not having insurance does the excuse the fact of neglect from by contractor doing the work. Start with them but no matter what get a police report as soon as possible if you plane to pursue this.  Your neighbor is liable for your damage even if done by a contractor.

Sorry to hear of your predicament. I would not call the police as this is a civil matter and not a criminal matter. I would take pictures of the damage to the car, take pictures of the freshly chainsawed tree. Get the contact information of your neighbor that doesn't want to get involved so you can have him served with a subpoena to testify to what he knows. Perhaps he'll be more forth coming while under oath in a civil court proceedings, where he is required to tell the whole truth and nothing but the truth so help him... Have your son file a civil complaint in small claims court and take it from there. That is what I would suggest.

At this point my neighbor has conceded the damage was caused by the persons he had trimming his trees. It is rather clear and impossible to argue. You can see marks where the branch was dragged off of the car and chain saw chips alongside the car. Pics have been taken.

 

The people doing the trimming were not insured, they did not have township permits if they were not insured.

 

My neighbor is turning it into his home insurance to see if it can be resolved in that manner.

 

As for a police report it would not amount to anything because it is a civil dispute. They would record it but not investigate it. This info per a retired local detective whom I hold in high respect.

 

Licenses and inspections could make it uncomfortable for both my neighbor and the tree trimmer because there were no permits issued but I don't know what good that would do for my son in financial restitution.

 

For know my son will wait to see if my neighbors property insurance will do anything.

 

If nothing is done probably off to L&I for ammunition in court.

 

I  should note the damage appears to be limited to a large dent in the roof. I do not think a difficult repair.

The fact that it put a decent dent into a classic Mustang means it must have been one heavy branch since the steel on cars of that era was quite a bit thicker than in cars today. Depending on what the rest of the body looks like, when you have to repair a roof, it means replacing the headliner and probably painting the entire car since matching the paint will be nearly impossible between the roof and the body with no seams to separate them. If your son or any of his friends have any auto-body experience this might be a great opportunity to get the car back in running condition and painted since the repair bill will be based on shop prices. Get quotes for having the work done "right" which hopefully means a full paint job, get paid by the insurance company then use the money to get the car in good shape. If it's a desirable year and doesn't have any or many modifications from the original equipment, he could just keep the money and sell the car as is. Nothing unethical about it at all and perfectly legal.

 

If he happens to have a 65 to 69 fastback, it's worth a small fortune even in not-so-perfect condition. Restored ones go for upwards of $70,000 here in California.

 

Glad the neighbor owned up to what happened and hopefully he'll do the right thing. Since his tree trimmer wasn't licensed and the job not permitted, he's on the hook for the damage personally, and his home owners insurance may not conver it because of that.

Police report, police report, police report. The insurance company will ask if he has one. It is easier for the insurance company to go after someone if they have a police report. With out one the claim will go against the insured (your son). I know because I found out the hard way myself a few weeks back.  :rant:
